Unlawful Debt Collection

The problems of harassing debt collection and collection attempts on bills that are not owed resulted in legislation by both Congress and the Oregon Legislature, in the form of the federal Fair Debt Collection Practices Act, and the Oregon Unlawful Debt Collection Practices Act. Both consumer statutes are premised upon the same fundamental principles that, first, collection agencies should only attempt to collect (or "dun") valid debts, and second, that dunning should be conducted in a professional, non-abusive manner.

In general, if a consumer disputes a debt in writing, the collection agency must provide the consumer with a verification of the underlying bills. If the debt is not owed, consumers should inform the collection agency and request that collection attempts be terminated. Continued dunning is potentially in violation of debt collection laws.

Even where a consumer does owe a debt, they have a right to be treated respectfully, and not to be harassed. Collectors cannot use profanities, threats of physical harm, or threaten to take actions that they cannot lawfully take. Collectors also cannot call debtors at work if they are asked not to, and cannot talk to co-workers or supervisors about the debt.

The Fair Debt Collection Practices Act is a federal statute that protects consumers from unfair or unconscionable collection practices by debt collectors. The Unlawful Debt Collection Practices Act is an Oregon statute that protects consumers from unfair or unconscionable collection practices by debt collectors, including the original creditor.
